These Terms of Use (“Terms”) govern your use of www.rhollensheadautosales.com (the “Site”), operated by R. Hollenshead Auto Sales, Inc. (“RHAS,” “we,” or “us”). By using the Site, you agree to these Terms. If you do not agree, do not use the Site.

1. About the Site

The Site provides general information about RHAS and its affiliated companies and services. RHAS sells to the automotive trade only. Nothing on the Site is an offer to sell a vehicle to the public.

2. Inventory, Pricing, and Market Information

Inventory listings on the Site are provided through HeadStart VMS and may change at any time without notice. Vehicles are subject to prior sale, and listings may contain errors in description, condition, equipment, mileage, or price. Valuation, market, and diminished-value information on the Site is general information, not an appraisal or professional advice. Any purchase or sale is governed solely by a separate written agreement between you and RHAS or the applicable affiliate, not by these Terms.

3. Acceptable Use

You agree not to:

  • use the Site for any unlawful purpose or in violation of these Terms;
  • attempt to gain unauthorized access to the Site, its servers, or any connected system;
  • interfere with or disrupt the Site, including by introducing malware or overloading it;
  • use automated tools to scrape, copy, or harvest content or data from the Site, including inventory listings, without our written permission; or
  • misrepresent your identity or your affiliation with any person or business.

4. Intellectual Property

The Site and its content, including text, graphics, logos, and images, are owned by RHAS or its licensors and are protected by copyright and trademark laws. You may view and print pages for your own business use. You may not otherwise copy, modify, distribute, or create works based on the Site without our written permission. Other company and product names on the Site may be trademarks of their respective owners.

5. Information You Send Us

If you send us feedback or suggestions, we may use them without any obligation to you. Personal information you send us is handled as described in our Privacy Policy.

6. Third-Party Sites and Content

The Site links to, and embeds content from, other websites, including our affiliated companies and HeadStart VMS. We are not responsible for the content, availability, or practices of sites we do not control, and a link is not an endorsement. Your use of those sites is governed by their own terms.

TO THE FULLEST EXTENT PERMITTED BY LAW, RHAS AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, OR BUSINESS, ARISING OUT OF OR RELATED TO YOUR USE OF, OR INABILITY TO USE, THE SITE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. Some jurisdictions do not allow these limitations, so they may not apply to you.

9. Indemnification

You agree to defend, indemnify, and hold harmless RHAS and its affiliates from any claims, losses, and expenses, including reasonable attorneys’ fees, arising from your violation of these Terms or misuse of the Site.

10. Governing Law and Venue

These Terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to its conflict-of-laws rules. Any dispute arising out of or relating to these Terms or the Site must be brought exclusively in the state or federal courts located in or serving Lancaster County, Pennsylvania, and you consent to the personal jurisdiction of those courts.

11. Changes and Termination

We may change these Terms or the Site at any time by posting updated Terms on this page. Your continued use of the Site after changes are posted means you accept them. We may suspend or end your access to the Site at any time.

12. General

If any provision of these Terms is found unenforceable, the remaining provisions stay in effect. Our failure to enforce any provision is not a waiver of it. These Terms and our Privacy Policy are the entire agreement between you and RHAS regarding the Site.
